While Copyright per se does not cover plant varieties, people should be aware of the difference between Copyright and Patents or Plant Breeder’s Rights.

Copyright does not require a registration process, but arises automatically for the creator unless there is a contract between parties stating that ownership does not lie with the creator (or employer). This is important for those involved in a breeding program where publications or other documentation or copyright material arises. If investors or others who would not normally hold the copyright wish to do so, they need a contract with the automatic copyright holder stating this change.
