2.6 USING PLANT BREEDER'S RIGHTS

Plant Breeder's Rights is a “patent-like” (sui generis) system of Intellectual Property developed specifically for breeders of new plant varieties. It enables them to obtain intellectual property rights for their “inventions” and therefore provides a framework to assist them to obtain a commercial return on their investment in the breeding program.

This section examines the issues a breeder or investor needs to consider when determining whether to seek Plant Breeder's Rights or another form of Intellectual Property protection for the new variety.
