
3.2 APPLICATIONS
The Plant Breeder's Rights Act 1994 sets out the rules relating to applications and how they are dealt with. The Plant Breeder's Rights Office from time to time provides additional Guidelines which are usually published in the on-line Plant Varieties Journal. The following sections of this Guide provide the basic information for prospective Applicants. More information can also be found on the IP Australia/Plant Breeder's Rights web site.
Under the PBR legislation, new varieties of all plant, fungal, algal species and transgenic plants are eligible for protection if they meet the relevant criteria.
