One of the key issues for Plant Breeder's Rights is understanding what constitutes plant breeding if the "breeder" (or assignee) is the only person eligible to apply for PBR. For example, one of the key issues raised throughout the history of PBR and PVR in Australia has been whether or not selections from the wild and discoveries can be granted rights if they meet the DUS and prior sale conditions of the Act. This is discussed further in a paper "Discovery and Selective Breeding" and in the Report, commissioned by the Plant Breeder's Rights Office, from the Expert Panel on Plant Breeding.
