Section 26 of the PBR Act provides that the Application must be in writing and in the approved form. The Application Forms can be downloaded from the IP Australia web site. The application can be made by the breeder (or person authorised under Section 24 - see Section 3.2.1 of this Guide) or by an authorised agent.

If the applicant is from another country then they must have an agent in Australia (Section 26(3)). At the same time as submitting the application the name of the new plant variety will need to be included, in accordance with Section 20 of the PBR Act (see Section 4.10 of this Guide – Naming a New Variety).
