3.9 EXEMPTIONS AND RESTRICTIONS


Article 15 of the 1991 UPOV Convention provides the basis for exemptions to the Plant Breeder’s Rights. These have been incorporated into the Australian Plant Breeder's Rights Act and are listed below.

Farmer saved seed (or other propagating material)
Experimentation (research) and plant breeding
Innocent Infringement
Public Access and Compulsory Licences
Equitable remuneration.

This Section should be read in conjunction with Section 6 of this Guide on Infringement and Enforcement.
