Section 37 of the PBR Act outlines the requirements if the Secretary requires more information through a test growing or further test growing for varieties in Australia, in relation to application, objection or request for revocation. In such cases the Registrar must serve a notice on the Applicant who is responsible for organising the test growing through a Qualified Person, in accordance with the provisions of the Notice. The information must be provided within 2 years of the date of service of the Notice for trees and vines and 12 months for other plant types, unless the Secretary agrees to another time frame.

If a person fails to comply with the provisions of the Notice the Secretary may revoke existing PBR or refuse to continue with an application or request for revocation.
