A3 END POINT ROYALTIES

One of the forms of contractual arrangement which is gaining support amongst growers and breeders is one that provides for the PBR grantee to obtain a royalty on the harvested product rather than the propagating material.

This should not be confused with the situation where the grantee can seek to exercise Plant Breeder's Rights over the harvested material or products from harvested material under with section 14 or section 15 . End Point Royalties are a contractual arrangement entered into when sections 14 and 15 do not apply (see Section 3.1 of the "Understanding Plant Breeder's Rights web site).
