
A6 GROWER AND DISTRIBUTOR CONTRACT
A grower may enter into a contract with a distributor or a retailer who is not the owner or licensee of the variety. The contract states that the distributor or retailer will purchase certain quantities of harvested material (eg apples, peas, grain) of a given protected variety and the distributor or retailer will take a percentage of the value of the product before on-selling. In the contract this percentage may be called a royalty, a commission, or simply a percentage of the market value. It is on the quantity of harvested material sold by the grower and would not generally be covered by PBR provisions – it is purely contractual and can be negotiated between the parties without reference to the owner or licensee of the PBR.
