Indigenous Law, Intellectual Property, Traditional Knowledge and Trade

This presentation examined the commonalities and distinctions in the approach to protection of traditional knowledge taken by the Nagoya Protocol, the Working Group on Article 8(j) of the Convention on Biological Diversity, the WIPO Intergovernmental Committee on Intellectual Property, Genetic Resources, Traditional Knowledge and Folklore (IGC), free trade agreements such as the Trans Pacific Partnership (TPP), and Indigenous peoples’ customary laws and protocols. It highlighted the challenges facing CGIAR Centres in this evolving legal landscape and describes how the guidelines on implementation of the Nagoya Protocol can help Centres respond to these challenges while minimising disruption to their day-to-day activities.
